Según el Plan de Uso y Gestión de Suelo (PUGS), aprobado el 13 de septiembre de 2021, la habilitación de suelo implica el cumplimiento obligatorio de las cargas impuestas por el planeamiento urbanístico y los instrumentos de gestión de suelo y es requisito previo indispensable para el otorgamiento de un permiso o autorización de edifico con construcción.
La Licencia Metropolitana Urbanística LMU-10 es aquella que autoriza el inicio de la ejecución de obras de habilitación de suelo una vez que se obtenga el certificado de conformidad del cumplimiento de las reglas técnicas y normas administrativas. Los actos de habilitación de suelo con esta licencia son los siguientes: las subdivisiones, las Restructuraciones Parcelarias y las Urbanizaciones.
Las Subdivisiones
Son proyectos con propuestas que pueden ser incentivadas por el municipio de manera privada con el fin de habilitar predios conforme a la normativa y los instrumentos de planificación, realizadas en suelo urbano o rural.
Si el suelo es urbano, la división no podrá ser mayor a 10 lotes o solares, sin incluir de las áreas verdes y comunales, además se deberá presentar las propuestas técnicas para la realización de las obras de infraestructura y vialidad.
Si el suelo es rural, la división no podrá ser mayor a 20 lotes, sin incluir de las áreas verdes y comunales, además se deberá presentar las propuestas técnicas para la realización de las obras de infraestructura y vialidad.
Los tipos de subdivisiones pueden ser las sujetas a reglamentación general, por partición judicial, por edificación protegida e inventariada o por intervención de entidades públicas.
Restructuraciones Parcelarias
Estos proyectos son trazados nuevos de parcelaciones aprobadas por el DMQ, y se realizan entre los lotes de cuerpo cierto de propiedad metropolitana y particular o entre bloques de cuerpo cierto particulares, con el fin de Regularizar la configuración de parcelas o nuevo trazado de parcelaciones defectuosas; Distribuir equitativamente entre los propietarios los beneficios y cargas de la ordenación urbana; y, relinderar predios colindantes, sin que esto implique división de lotes a pesar de que pueda producirse un reajuste de áreas en los predios involucrados.
En caso de integración parcelaria, la que consiste en la unión de dos o más lotes en un solo cuerpo, el DMQ procede a catastrar el lote, resultado de la integración, a través del organismo responsable del catastro metropolitano.
Urbanizaciones
Estos proyectos son propuestas que pueden ser iniciadas por el municipio o de manera privada. Tienen la finalidad de dividir y habilitar el suelo calificado específicamente por el Plan Metropolitano de Desarrollo y Ordenamiento Territorial u otros instrumentos de planificación.
Los proyectos de urbanizaciones no pueden modificar las previsiones del PUGS, ni las determinaciones normativas sobre la ordenación, uso y edificación. También, deben integrar redes de infraestructura y vialidad a las redes generales (existentes y previstas), Además deberán adjuntar los certificados de factibilidad de servicio y las propuestas técnicas para la ejecución de obras e infraestructura vial.
Las urbanizaciones pueden ser las siguientes:
1. Urbanizaciones sujetas a reglamentación general
Este tipo de proyecto puede ser promovido por cualquier persona natural o jurídica. A su vez, deben contar con el informe favorable de la Secretaría de Territorio, Hábitat y Vivienda; y garantizar la transferencia de áreas verdes y áreas comunales al DMQ.
2. Urbanizaciones de interés social y desarrollo progresivo
Se desarrollan por organizaciones sociales legalmente constituidas que cumplan con los requisitos legales, socio-organizativos, y técnicos previstos. A su vez, deben garantizar la transferencia de áreas verdes y las áreas de equipamiento comunal al DMQ, y la consolidación plena en un plazo especial máximo de 8 años. Como garantía del cumplimiento de las etapas en urbanizaciones de interés social progresivo, los lotes son gravados con primera hipoteca, permitiéndose segunda hipoteca siempre y cuando la Autoridad Administrativa Otorgante de la LMU-10 lo apruebe.
Los proyectos de urbanización deben identificar las etapas a ejecutarse conforme a un cronograma valorado de obras. También, las obras de infraestructura pueden realizarse por etapas y se las entrega al DMQ o a las Empresas Públicas Metropolitanas una vez que se hayan concluido. No obstante, la garantita de que las etapas en las etapas de interés social de desarrollo progresivo se cumplan, los lotes son gravados con primera hipoteca y en casos especiales el DMQ acepa una segunda hipoteca que requiere un informe favorable de la Procuraduría Metropolitana.
Las etapas para urbanizaciones de interés social de desarrollo progresivo se desarrollan en las siguientes etapas: Etapa de Implantación, Etapa de Conformación y Etapa de Consolidación.
Cual fuese la figura de habilitación de suelo, el PUGS menciona que se deberán observar las dimensiones y las superficies mínimas de los lotes, el los grados o porcentajes de pendientes y lo establecido en los planes complementarios.
